Tweenery

Terms of Service

Last updated: November 2, 2026

These Terms of Service ("Terms") are a binding agreement between you and Stanislav Martin Babak, an individual doing business as Tweenery ("Tweenery", "we", "us"). They govern your use of tweenery.com, the Tweenery app and every related service (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Please read Section 17 carefully. It requires most disputes to be resolved by binding individual arbitration and waives your right to a jury trial and to take part in a class action, unless you opt out.

1. Who can use Tweenery

2. Your account

3. What the Service does

Tweenery is an AI agent that creates and edits visual content, such as social media carousels and, in future, videos and motion graphics, from your instructions, uploads and reference links. To do this it sends your instructions and materials to third-party AI model providers, runs code in isolated cloud sandboxes, generates images, and may fetch public web pages and social media posts you point it to.

The Service is evolving. We may add, change, limit or remove features, models, formats, limits and prices at any time. Some features may be labeled beta or experimental; they may be unreliable and can be withdrawn without notice.

4. Credits and payment

5. Your content

"Your Content" means everything you put into the Service (prompts, messages, uploads, brand details, links) and everything the Service generates for you (text, slides, images, videos and other files, together "Output").

6. AI output: important limits

You understand and accept that:

7. Reference posts and links

You can ask Tweenery to study a post, page or image you provide and create something new in a similar style. When you do:

8. Acceptable use

You must not use the Service, or help anyone else use it, to:

We may (but are not required to) monitor, review, refuse to process or remove any content, and may report illegal content to the authorities. Our AI providers may also refuse requests that break their policies.

9. Third-party services

The Service relies on third parties, including AI model providers, hosting, storage, email and sign-in providers, and sites you link to. We are not responsible for their services, content, availability, outages, errors, policy changes or price changes, or for how they handle data under their own terms. If a provider changes or stops a model or feature, we may change or remove it from the Service.

10. Our rights

We and our licensors own the Service, including its software, design, prompts, templates, and the Tweenery name and logo. These Terms give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service as allowed here; nothing else is licensed to you. If you send us feedback or ideas, we may use them freely without owing you anything.

11. Your files and backups

The Service is not a backup or archive service. Projects and files may be lost, corrupted or become unavailable because of bugs, outages, provider failures, account closure or deletion. Download and keep your own copies of anything you want to keep. We are not liable for lost data or content. Download links we give you expire after a short time.

12. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to support@tweenery.com with: your contact details; a description of the copyrighted work; where the infringing material is on the Service; a statement that you have a good-faith belief the use is not authorized by the owner, its agent or the law; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We may remove the material and, where appropriate, close the accounts of repeat infringers. If your content was removed and you believe it was a mistake, you can send a counter-notice to the same address.

13. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or close your account, limit your access, or remove content at any time, with or without notice, if we reasonably believe you broke these Terms or the law, created risk or harm for us, other users or third parties, did not pay, or if we stop offering the Service. If we close your account without cause, we will try to give reasonable notice. When an account is closed, credits are forfeited and content may be deleted without recovery. Sections that by their nature should survive (including 4, 5, 6, 10, 11 and 14 to 19) survive termination.

14. Disclaimer of warranties

The Service and all Output are provided "as is" and "as available", with all faults and without warranties of any kind. To the fullest extent permitted by law, we disclaim all warranties, express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, quality and quiet enjoyment, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, timely, secure or error-free, that defects will be corrected, that Output will be accurate, original, lawful, non-infringing or fit for your purpose, or that content will be stored without loss. You use the Service and Output at your own risk.

15. Limitation of liability

To the fullest extent permitted by law, Stanislav Martin Babak and Tweenery, and their affiliates, contractors, suppliers and licensors, will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, followers, reputation, data or content, or costs of substitute services, arising out of or related to these Terms, the Service or any Output, whether based on warranty, contract, tort (including negligence), strict liability or any other theory, even if we were told such damages were possible. Our total liability for all claims arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim and (b) fifty US dollars (US$50). These limits apply even if a remedy fails of its essential purpose.

Some places do not allow certain exclusions or limits, so some of the above may not apply to you. In that case our liability is limited to the smallest amount the law allows. Nothing in these Terms limits liability that cannot legally be limited, such as for fraud or, where applicable, death or personal injury caused by negligence.

16. Indemnity

To the extent the law allows, you will defend, indemnify and hold harmless Stanislav Martin Babak, Tweenery and their contractors and suppliers from any claims, damages, losses, liabilities, fines, costs and expenses (including reasonable legal fees) arising out of or related to: Your Content; your use of Output, including publishing or advertising with it; your breach of these Terms or of any law; or your violation of anyone else's rights, including intellectual property, privacy and publicity rights. We may take control of the defense of any such claim at your cost, and you will cooperate with us.

17. Disputes and arbitration

Talk to us first. Before filing any claim, you agree to email support@tweenery.com with a description of the dispute and try to resolve it informally for at least 60 days.

Binding arbitration. If we cannot resolve it, you and we agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, under the Federal Arbitration Act. The arbitrator, not a court, decides questions about the scope and enforceability of this section. Arbitration may be held by video or phone, or in the county where you live.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies, and either party may ask a court for an injunction to stop infringement or misuse of intellectual property.

No class actions or jury trials. You and we may each bring claims only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding, and we each waive the right to a jury trial. If this class-action waiver is found unenforceable for a claim, that claim must be decided in court, not arbitration.

Opting out. You can opt out of this arbitration agreement by emailing support@tweenery.com within 30 days after you first accept these Terms, stating your name, account email and that you opt out of arbitration.

Time limit. To the extent the law allows, any claim must be filed within one year after it arises, or it is permanently barred.

If you live in the EU, the UK or another country where these provisions are not allowed for consumers, they do not take away the protections of your local law, and you may bring claims in the courts where you live.

18. Governing law

These Terms are governed by the laws of the State of New Hampshire, USA, and applicable US federal law, without regard to conflict-of-law rules. Subject to Section 17, the state and federal courts located in New Hampshire have exclusive jurisdiction, and you and we consent to their personal jurisdiction.
